Diritto di recesso

L’Utente è tuttavia libero di esprimere la propria intenzione di recedere dal contratto in ogni altra forma idonea. Al fine di rispettare il periodo entro il quale dev’essere esercitato il diritto, l’Utente deve inviare la dichiarazione di recesso prima che scada il termine di recesso.

Quando scade il termine di recesso?

  • In caso di acquisto di beni, il termine di recesso scade dopo 14 giorni dal giorno in cui l’Utente o un terzo – da questi incaricato e diverso dal corriere –prende possesso dei beni.

  • In caso di acquisto di più beni ordinati insieme ma consegnati separatamente o in caso di acquisto di un singolo bene composto di diversi lotti o pezzi consegnati separatamente il termine di recesso scade dopo 14 giorni dal giorno in cui l’Utente o un terzo – da questi incaricato e diverso dal corriere – prende possesso dell’ultimo dei beni, lotti o pezzi.

Effetti del recesso

Il Titolare rimborsa tutti i pagamenti ricevuti compresi, se effettuati, quelli relativi alle spese di consegna agli Utenti che abbiano correttamente esercitato il diritto di recesso.

Tuttavia, il maggior costo derivante dalla scelta di un particolare metodo di consegna diverso dalla consegna standard più economica offerta dal Titolare, resterà a carico dell’Utente.

Il rimborso avviene senza indebito ritardo ed in ogni caso entro 14 giorni dal giorno in cui il Titolare è stato informato della decisione dell’Utente di recedere dal contratto. Salvo ove diversamente pattuito con l’Utente, il rimborso è effettuato utilizzando lo stesso mezzo di pagamento utilizzato per la transazione iniziale. L’Utente non deve sostenere alcun costo quale conseguenza del recesso.

A meno che il Titolare non si sia offerto di ritirare i beni, l’Utente è tenuto a riconsegnarli al Titolare o ad altra persona da questi autorizzata a riceverli senza indebito ritardo ed in ogni caso entro 14 giorni dal giorno in cui ha comunicato la propria intenzione di recedere dal contratto.

Il termine è rispettato se la consegna dei beni al corriere o ad altra persona autorizzata avviene prima della scadenza del periodo di 14 giorni sopra descritto. Il rimborso può essere trattenuto sino a ricezione dei beni o sino a quando l’Utente abbia fornito prova di averli restituiti.

L’Utente risponde della diminuzione del valore dei beni derivante da un utilizzo dei beni diverso da quello necessario per stabilirne la natura, le caratteristiche e il funzionamento.

Le spese di spedizione del reso sono a carico dell’Utente.

Right to cancel

Unless exceptions apply, Users who are Consumers in the United Kingdom have a legal right of cancellation under UK law and may be eligible to withdraw from contracts made online (distance contracts) within the period specified below (generally 14 days), for any reason and without justification.

Exercising the right to cancel

To exercise their right to cancel, Users must send to the Owner an unequivocal statement of their intention to withdraw from the contract. To this end, Users may use the model withdrawal form available from within the “definitions” section of this document. Users are, however, free to express their intention to withdraw from the contract by making an unequivocal statement in any other suitable way. In order to meet the deadline within which they can exercise such right, Users must send the withdrawal notice before the cancellation period expires. When does the cancellation period expire?

  • Regarding the purchase of goods, the cancellation period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – takes physical possession of the goods.
  • Regarding the purchase of several goods ordered together but delivered separately or in case of purchase of a single good consisting of multiple lots or pieces delivered separately, the cancellation period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – acquires physical possession of the last good, lot or piece.
  • Regarding the purchase of a service, the cancellation period expires 14 days after the day that the contract is entered into, unless the User has waived the right to cancel.
Effects of cancellation

Users who correctly withdraw from a contract will be reimbursed by the Owner for all payments made to the Owner, including, if any, those covering the costs of delivery.

However, any additional costs resulting from the choice of a particular delivery method other than the least expensive type of standard delivery offered by the Owner, will not be reimbursed.

Such reimbursement shall be made without undue delay and, in any event, no later than 14 days from the day on which the Owner is informed of the User’s decision to withdraw from the contract. Unless otherwise agreed with the User, reimbursements will be made using the same means of payment as used to process the initial transaction. In any event, the User shall not incur any costs or fees as a result of such reimbursement.

…on the purchase of physical goods

Unless the Owner has offered to collect the goods, Users shall send back the goods or hand them over to the Owner, or to a person authorized by the latter to receive the goods, without undue delay and in any event within 14 days from the day on which they communicated their decision to withdraw from the contract.

The deadline is met if the goods are handed to the carrier, or otherwise returned as indicated above, before the expiration of the 14-days-period for returning the goods. The reimbursement may be withheld until reception of the goods, or until Users have supplied evidence of having returned the goods, whichever is the earliest.

Users shall only be liable for any diminished value of the goods resulting from the handling of the goods outside of that which is necessary to establish their nature, characteristics and functioning.

The costs of returning the goods are borne by the User.

Where a User exercises the right to cancel after having requested that the service be performed before the cancellation period expires, the User shall pay to the Owner an amount which is in proportion to the part of service provided.

  • Em relação à aquisição de um serviço, o prazo de arrependimento é de 7 (sete) dias após a data da celebração do contrato, e somente se o serviço ainda não tiver sido prestado.
Efeitos do arrependimento

Os Usuários que rescindirem corretamente um contrato serão reembolsados pelo Proprietário por todos os pagamentos feitos ao Proprietário, incluindo, se houver, aqueles que cobrem os custos de entrega.

No entanto, não serão reembolsados quaisquer custos adicionais resultantes da escolha de um método de entrega específico que não seja o tipo de entrega padrão mais barato oferecido pelo Proprietário.

O prazo terá sido cumprido se o produto for entregue ao transportador ou devolvido, conforme indicado acima, antes do fim do prazo de 14 (catorze) dias estipulado para a devolução. O reembolso pode ser retido até a recepção dos produtos ou até que os Usuários apresentem prova da devolução, o que ocorrer primeiro.

Os Usuários só serão responsáveis pela redução do valor dos produtos que resulte do manuseio além do necessário para a garantia de sua natureza, características e funcionamento.

Os custos de devolução dos produtos serão arcados pelo Proprietário.

Questa sezione sulla limitazione di responsabilità si applica nei limiti massimi consentiti dalla legge nella giurisdizione applicabile, indipendentemente dal fatto che la presunta responsabilità derivi da contratto, atto illecito, negligenza, responsabilità oggettiva o da qualsiasi altro fondamento, anche se l’Utente era stato avvisato della possibilità del verificarsi di tale danno.

  • qualsiasi contenuto inviato dall’account dell’Utente, incluse, a titolo esemplificativo ma non esaustivo, informazioni fuorvianti, false o imprecise e compreso anche il caso in cui l’accesso venga effettuato da terzi con username e password personali dell’Utente o altre misure di sicurezza, se presenti;
  • la condotta dolosa dell’Utente; o
  • la violazione di qualsivoglia disposizione legale da parte dell’Utente o dei suoi affiliati, funzionari, agenti, contitolari del marchio, partner, fornitori e dipendenti, nei limiti consentiti dalla legge applicabile

Disposizioni comuni

Nessuna rinuncia implicita

Il mancato esercizio di diritti di legge o pretese derivanti da questi Termini da parte del Titolare non costituisce rinuncia agli stessi. Nessuna rinuncia può essere considerata definitiva in relazione ad uno specifico diritto o a qualsiasi altro diritto.

Interruzione del Servizio

Proceso de compra

Envío del pedido

Ofertas y descuentos

El Titular podrá ofrecer descuentos o realizar ofertas especiales por la compra de Productos. Todas estas ofertas o descuentos estarán sujetas en todo caso a los criterios de admisión y a los términos y condiciones establecidas en la sección correspondiente de esta Página Web.

Las ofertas y descuentos siempre se conceden a la entera discreción del Titular.

Las ofertas o descuentos repetidos o recurrentes no crearán ninguna acción o derecho que los Usuarios puedan ejercitar en el futuro.

Dependiendo de cada caso, los descuentos o las ofertas únicamente serán válidos durante un tiempo limitado o mientras duren las existencias. Si una oferta o un descuento están limitados en el tiempo, los parámetros temporales se referirán a la zona horaria del Titular, según lo señalado en los datos de localización del Titular en el presente documento, salvo que se indique lo contrario.

Métodos de pago

Se facilitará la información relativa a los métodos de pago aceptados durante el proceso de compra.

Algunos métodos de pago solo estarán disponibles sujetos a condiciones o comisiones adicionales. En esos casos, la información relativa a estos podrá encontrarse en la sección específica de esta Página Web.

Todos los pagos se tramitan de forma independiente a través de servicios de terceros. Por consiguiente, esta Página Web no recoge ninguna información de pago – como datos de tarjetas de crédito – sino que únicamente recibe una notificación una vez que se ha completado satisfactoriamente el pago. Pago fraccionado del precio

El pago del precio de compra podrá abonarse en dos o más pagos fraccionados, dentro de los plazos establecidos en esta Página Web o comunicados de cualquier otro modo por el Titular.
Se podrán excluir Productos específicos de este modelo de pago.
Si el Usuario incumple alguno de los plazos de pago, la totalidad del importe restante pasará a considerarse inmediatamente vencido, líquido y exigible.

Reserva de dominio sobre el Producto

Hasta que el Titular haya recibido el pago íntegro del precio de compra, el Usuario no adquirirá la propiedad de los Productos objeto del pedido.

Retención de los derechos de uso

Los Usuarios no adquirirán ningún derecho a utilizar el Producto adquirido hasta que el Titular haya recibido íntegramente el precio de compra.

Entrega

Las entregas se realizarán en la dirección indicada por el Usuario y de la forma especificada en el resumen del pedido.

Una vez realizada la entrega, los Usuarios deberían comprobar el contenido de dicha entrega y notificar cualquier anomalía sin demoras indebidas, utilizando los datos de contacto que se señalan en el presente documento o según lo descrito en el albarán de entrega. Los Usuarios podrán negarse a aceptar el paquete si está visiblemente dañado.

Se efectúan entregas de bienes en los países o territorios especificados en la sección correspondiente de esta Página Web.

Los plazos de entrega se especifican en esta Página Web o durante el proceso de compra.

Entrega fallida

No se podrá exigir responsabilidad al Titular por los errores en la entrega debidos a inexactitudes o a que el Usuario no haya completado la ejecución del pedido de compra, ni tampoco por cualesquiera daños o retrasos que se produzcan tras la entrega a cualquier transportista organizado por el Usuario y no ofrecido o recomendado por el Titular.

Si los bienes no se reciben o recogen en el momento o dentro del plazo especificados, los bienes se devolverán al Titular, que contactará con el Usuario para organizar un segundo intento de entrega o para acordar cómo proceder en el futuro.

Salvo acuerdo en contrario, cualquier intento de entrega a partir del segundo será por cuenta del Usuario.

Prestación de los servicios

El servicio contratado se prestará o se facilitará en el plazo especificado en esta Página Web o según lo comunicado antes del envío del pedido.

Derechos de los Usuarios

Derecho de desistimiento

Salvo en caso de que sea aplicable alguna excepción, los Usuarios podrán desistir del contrato en el plazo señalado a continuación (por lo general, 14 días), por cualquier motivo y sin necesidad de justificación. Los Usuarios pueden obtener más información sobre las condiciones de desistimiento en esta sección.

A quiénes les resulta aplicable el derecho de desistimiento

Salvo en caso de que se mencione a continuación una excepción aplicable, los Usuarios que sean Consumidores europeos disfrutan de un derecho de cancelación establecido por ley con arreglo al Derecho de la UE, que les permite desistir de contratos celebrados en línea (contratos a distancia) dentro del plazo indicado que sea aplicable a su caso, por cualquier motivo y sin necesidad de justificación.

Los Usuarios que no entren en esta categoría no podrán disfrutar de los derechos descritos en esta sección. El Consumidor solo será responsable ante el Vendedor de cualquier reducción en el valor de los bienes resultante de la manipulación de los bienes de una manera distinta de la necesaria para tomar conocimiento de la naturaleza, las características y la funcionalidad de los bienes.

Ejercicio del derecho de desistimiento

Para ejercitar el derecho de desistimiento, los Usuarios deberán enviar al Titular una declaración inequívoca de su intención de desistir del contrato.

A tal fin, los Usuarios podrán utilizar el modelo de formulario de desistimiento que aparece en la sección de «definiciones» del presente documento. No obstante, los Usuarios son libres de expresar su intención de desistir del contrato efectuando una declaración inequívoca de cualquier otro modo que sea oportuno. Con el fin de cumplir el plazo en el que se debe ejercitar este derecho, los Usuarios deberán enviar la notificación de desistimiento antes de que expire el plazo de desistimiento.

¿Cuándo finaliza el plazo de desistimiento?

  • En cuanto a la adquisición de bienes, el plazo de desistimiento expirará 14 días a partir del día en que el Usuario o un tercero – distinto del transportista e indicado por el Usuario – tomen posesión material de los bienes.

  • En cuanto a la adquisición de varios bienes encargados en el mismo pedido pero entregados por separado o en caso de adquisición de un único bien consistente en múltiples componentes o piezas entregados por separado, el plazo de desistimiento expirará 14 días a partir del día en que el Usuario o un tercero – distinto del transportista e indicado por el Usuario – adquieran la posesión material del último bien, componente o pieza.

  • En cuanto a la contratación de un servicio, el plazo de desistimiento expirará 14 días a partir del día en que se celebre el contrato, salvo que el Usuario haya renunciado a su derecho de desistimiento.

Efectos del desistimiento

El Titular reembolsará a los Usuarios que desistan correctamente de un contrato todos los pagos realizados al Titular, incluyendo, en su caso, los que sirvieran para cubrir los gastos de envío.

Sin embargo, no se reembolsarán los costes adicionales derivados de la elección de un método de envío concreto distinto de la forma de envío estándar menos costosa ofrecida por el Titular.

Dicho reembolso se realizará sin demoras indebidas y, en cualquier caso, como máximo 14 días a partir del día en que se informe al Titular de la decisión del Usuario de desistir del contrato. Salvo que se haya acordado lo contrario con el Usuario, los reembolsos se efectuarán utilizando los mismos medios de pago utilizados para tramitar la transacción inicial. En cualquier caso, el Usuario no incurrirá en ningún coste o tarifa a consecuencia de dicho reembolso.

…sobre la adquisición de bienes tangibles

Salvo que el Titular haya ofrecido realizar la recogida de los bienes, los Usuarios deberán enviar de vuelta los bienes o entregarlos en mano al Titular, o bien a una persona autorizada por este último para recibir los bienes, sin demoras indebidas y en todo caso dentro de un plazo de 14 días desde que comunicaran su decisión de desistir del contrato.

Se considerará cumplido el plazo si los bienes son entregados al transportista o devueltos de cualquier otro modo según lo indicado más arriba, antes de la expiración del período de 14 días para la devolución de los bienes. Podrá retenerse el reembolso hasta la recepción de los bienes o hasta que los Usuarios hayan aportado la prueba de que han devuelto los bienes, lo que suceda primero.

Los Usuarios solo serán responsables de la disminución de valor de los bienes derivada de la manipulación de los bienes que exceda de lo necesario para establecer su naturaleza, características y funcionamiento.

Los costes de la devolución de los bienes serán por cuenta del Usuario.

…sobre la contratación de servicios

Cuando un Usuario ejercite el derecho de desistimiento tras haber solicitado que el servicio sea prestado antes de la expiración del plazo de desistimiento, el Usuario deberá abonar al Titular un importe que sea proporcional a la parte del servicio que se haya prestado.

Dicho pago se calculará sobre la base del valor económico del servicio y será proporcional a la parte del servicio que se haya prestado hasta el momento en que el Usuario desista, en comparación con la cobertura completa del contrato.

UK User rights

Right to cancel

Unless exceptions apply, Users who are Consumers in the United Kingdom have a legal right of cancellation under UK law and may be eligible to withdraw from contracts made online (distance contracts) within the period specified below (generally 14 days), for any reason and without justification.

Users that do not qualify as Consumers, cannot benefit from the rights described in this section. Users can learn more about the cancellation conditions within this section.

Exercising the right to cancel

To exercise their right to cancel, Users must send to the Owner an unequivocal statement of their intention to withdraw from the contract. To this end, Users may use the model withdrawal form available from within the “definitions” section of this document. Users are, however, free to express their intention to withdraw from the contract by making an unequivocal statement in any other suitable way. In order to meet the deadline within which they can exercise such right, Users must send the withdrawal notice before the cancellation period expires. When does the cancellation period expire?

  • Regarding the purchase of goods, the cancellation period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – takes physical possession of the goods.
  • Regarding the purchase of several goods ordered together but delivered separately or in case of purchase of a single good consisting of multiple lots or pieces delivered separately, the cancellation period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – acquires physical possession of the last good, lot or piece.
  • Regarding the purchase of a service, the cancellation period expires 14 days after the day that the contract is entered into, unless the User has waived the right to cancel.
Effects of cancellation

Users who correctly withdraw from a contract will be reimbursed by the Owner for all payments made to the Owner, including, if any, those covering the costs of delivery.

However, any additional costs resulting from the choice of a particular delivery method other than the least expensive type of standard delivery offered by the Owner, will not be reimbursed.

Such reimbursement shall be made without undue delay and, in any event, no later than 14 days from the day on which the Owner is informed of the User’s decision to withdraw from the contract. Unless otherwise agreed with the User, reimbursements will be made using the same means of payment as used to process the initial transaction. In any event, the User shall not incur any costs or fees as a result of such reimbursement.

…on the purchase of physical goods

Unless the Owner has offered to collect the goods, Users shall send back the goods or hand them over to the Owner, or to a person authorized by the latter to receive the goods, without undue delay and in any event within 14 days from the day on which they communicated their decision to withdraw from the contract.

The deadline is met if the goods are handed to the carrier, or otherwise returned as indicated above, before the expiration of the 14-days-period for returning the goods. The reimbursement may be withheld until reception of the goods, or until Users have supplied evidence of having returned the goods, whichever is the earliest.

Users shall only be liable for any diminished value of the goods resulting from the handling of the goods outside of that which is necessary to establish their nature, characteristics and functioning.

The costs of returning the goods are borne by the User.

…on the purchase of services

Where a User exercises the right to cancel after having requested that the service be performed before the cancellation period expires, the User shall pay to the Owner an amount which is in proportion to the part of service provided.

Such payment shall be calculated based on the economic value of the service and be proportional to the part of service provided until the time the User withdraws compared to the full coverage of the contract.

Direito de arrependimento

Salvo se for estipulada abaixo uma exceção aplicável, os Usuários Consumidores no Brasil terão o direito legal de arrependimento de acordo com a legislação brasileira. Isto significa que o Consumidor tem o direito de rescindir os contratos online (contratos à distância ou celebrados fora do estabelecimento comercial) por qualquer motivo e sem justificativa, no prazo de 7 (sete) dias a contar da data da celebração do contrato ou do recebimento do produto ou serviço. Usuários que não se qualificam como Consumidores não podem se beneficiar dos direitos estabelecidos nesta seção. O direito de arrependimento poderá ser exercido pelo Consumidor por meio dos canais de contato indicados no início deste documento e de acordo com as orientações desta seção.

Exercício do direito de arrependimento

Para exercer o direito de arrependimento, os Usuários devem enviar ao Proprietário uma declaração inequívoca de sua intenção de rescindir o contrato. Para tanto, os Usuários poderão utilizar o modelo de formulário de rescisão disponível na seção “definições” deste documento. No entanto, os usuários são livres para expressar sua vontade de rescindir o contrato através de uma declaração inequívoca por qualquer via adequada. Para respeitar o prazo estabelecido para o exercício de tal direito, os Usuários devem enviar o aviso de arrependimento antes do fim do prazo. Quando termina o prazo de arrependimento?

  • Em relação à compra de produtos, o prazo de arrependimento é de 7 (sete) dias após a data de recebimento do produto pelo Usuário ou um terceiro designado pelo Usuário que não seja o transportador.

  • No caso de compra de múltiplos produtos encomendados em conjunto mas entregues de forma separada, ou no caso de compra de um único produto constituído por diversos lotes ou peças entregues de forma separada, o prazo de arrependimento é de 7 (sete) dias após a data de recebimento do último produto, lote ou peça pelo Usuário ou um terceiro designado pelo Usuário que não seja o transportador.

  • Em relação à aquisição de um serviço, o prazo de arrependimento é de 7 (sete) dias após a data da celebração do contrato, e somente se o serviço ainda não tiver sido prestado.
Efeitos do arrependimento

Os Usuários que rescindirem corretamente um contrato serão reembolsados pelo Proprietário por todos os pagamentos feitos ao Proprietário, incluindo, se houver, aqueles que cobrem os custos de entrega.

No entanto, não serão reembolsados quaisquer custos adicionais resultantes da escolha de um método de entrega específico que não seja o tipo de entrega padrão mais barato oferecido pelo Proprietário.

Este reembolso será realizado sem demora injustificada e no prazo máximo de 14 (catorze) dias, a contar do dia em que o Proprietário foi informado da decisão do Usuário de rescindir o contrato ou da devolução efetiva do produto, o que ocorrer por último. Salvo se acordado de outra forma com o Usuário, os reembolsos serão efetuados por meio do mesmo método de pagamento utilizado para processar a transação inicial. O Usuário não incorrerá em quaisquer custos ou taxas em razão de tal reembolso.

…na compra de produtos físicos

Salvo se o Proprietário tiver se disponibilizado para coletar os produtos, os Usuários devem devolvê-los ou entregá-los ao Proprietário ou a uma pessoa autorizada por este a receber os produtos, sem demora injustificada e no prazo de 14 (catorze) dias a contar da data da comunicação da decisão de rescisão do contrato.

O prazo terá sido cumprido se o produto for entregue ao transportador ou devolvido, conforme indicado acima, antes do fim do prazo de 14 (catorze) dias estipulado para a devolução. O reembolso pode ser retido até a recepção dos produtos ou até que os Usuários apresentem prova da devolução, o que ocorrer primeiro.

Os Usuários só serão responsáveis pela redução do valor dos produtos que resulte do manuseio além do necessário para a garantia de sua natureza, características e funcionamento.

Os custos de devolução dos produtos serão arcados pelo Proprietário.

…na compra de serviços

Quando o Usuário exerce o direito de arrependimento após a solicitação da execução do serviço, mesmo antes do fim do período de arrependimento, o Usuário deverá pagar ao Proprietário uma quantia que seja proporcional à parte do serviço prestado.

Tal pagamento será calculado com base no valor econômico do serviço e será proporcional à parte do serviço prestado até o momento em que o Usuário cancelar o serviço.

Exención de responsabilidad

El Usuario acuerda indemnizar y eximir de toda responsabilidad al Titular y a sus filiales, sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios y empleados frente a cualquier reclamación o demanda – incluyendo, con carácter enunciativo y no limitativo, los honorarios de abogados y las costas – formuladas por cualquier tercero debido a o en relación con una violación negligente de las presentes Condiciones, los derechos de terceros o las disposiciones establecidas por ley relacionadas con el uso del Servicio por parte del Usuario o de sus sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios y empleados hasta la máxima extensión permitida por la ley aplicable.

Lo anterior también se aplica a cualquier reclamación presentada por terceros (incluyendo, con carácter enunciativo y no limitativo, los clientes o consumidores del Titular) contra el Titular relativas a Productos Digitales suministrados por el Usuario como, por ejemplo, las reclamaciones relativas a la conformidad.

Limitación de responsabilidad

Salvo que se establezca expresamente lo contrario y sin perjuicio de la ley aplicable, el Usuario no podrá reclamar daños y perjuicios contra el Titular (ni contra ninguna persona física o jurídica que actúe en su nombre).

Lo anterior no será aplicable a los daños que afecten a la vida, la salud o la integridad física, los daños y perjuicios resultantes del incumplimiento de las obligaciones contractuales sustantivas, como cualquier obligación que sea estrictamente necesaria para lograr el objetivo del contrato, y/o a los daños y perjuicios resultantes del dolo o la negligencia grave, siempre y cuando el Usuario haya utilizado esta Página Web de forma apropiada y correcta.

Salvo que los daños hayan sido causados mediante dolo o negligencia grave, o que afecten a la vida, la salud o la integridad física, el Titular solo será responsable en la medida de los daños que fueran típicos y previsibles en el momento en el que se celebró el contrato.

Limitación de responsabilidad

Ninguna de las disposiciones de las presentes Condiciones excluye, limita o modifica ninguna de las garantías, condiciones, derechos o recursos de que disponga el Usuario con arreglo a la Competition and Consumer Act 2010 (Ley sobre Competencia y Consumidores de 2010, en lo sucesivo «Cth») o cualquier otra normativa de un estado o territorio y que no pueda excluirse, limitarse o modificarse (derecho no excluible). Exclusión de garantías

La utilización del Servicio será bajo la propia responsabilidad de los Usuarios. Ningún asesoramiento o información, ya sea en forma oral o escrita, obtenidos por el Usuario del Titular o a través del Servicio dará lugar a ninguna garantía que no se haya establecido expresamente en las presentes Condiciones.

Sin perjuicio de lo anterior, el Titular, sus filiales, sociedades afiliadas, licenciantes, directivos, administradores, agentes, cotitulares de marcas, socios, proveedores y empleados no garantizan que el contenido sea exacto, fiable o correcto; que el Servicio cumpla las exigencias de los Usuarios; que el Servicio esté disponible en un momento o lugar determinados, que no presente interrupciones ni que sea seguro; que todo defecto o error sea corregido; o que el Servicio esté libre de virus o de otros componentes dañinos. Todo contenido descargado o que se haya obtenido de cualquier otro modo mediante el uso del Servicio se descargará bajo la exclusiva responsabilidad de los Usuarios y los Usuarios serán los únicos responsables de cualquier daño que se produzca en los sistemas informáticos o dispositivos móviles de los Usuarios o de la pérdida de datos que resulte de dicha descarga o de la utilización del Servicio por parte de los Usuarios.

El Titular no garantiza, respalda ni asume responsabilidad alguna respecto de ningún producto o servicio publicitado u ofrecido por un tercero a través del Servicio o de cualquier página web o servicio conectados mediante enlaces, y el Titular no será parte ni supervisará de modo alguno ninguna transacción entre los Usuarios y los terceros proveedores de productos o servicios.

El Servicio puede resultar inaccesible o puede no funcionar correctamente con el navegador web del Usuario, su dispositivo móvil y/o su sistema operativo. No podrá exigirse responsabilidad alguna al Titular por cualesquiera daños y perjuicios presuntos o reales derivados de los contenidos, el funcionamiento o la utilización del presente Servicio.

Las leyes federales, de algunos Estados y de otras jurisdicciones no permiten la exclusión y limitación de determinadas garantías implícitas. Es posible que las exclusiones anteriormente mencionadas no sean aplicables a los Usuarios. El presente Contrato otorga derechos legales específicos a los Usuarios y los Usuarios pueden disponer de otros derechos, que variarán de un Estado a otro. Las cláusulas de exención de responsabilidad y exclusiones en virtud del presente Contrato no serán aplicables en la medida en que estén prohibidas por la ley aplicable.

Limitaciones de responsabilidad

En la máxima medida de lo permitido por la ley aplicable, en ningún caso serán responsables el Titular o sus filiales, sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios, proveedores y empleados respecto de:

  • cualesquiera daños y perjuicios de carácter indirecto, punitivo, incidental, especial, emergente o ejemplar, incluyendo, con carácter enunciativo y no limitativo, daños y perjuicios por pérdida de beneficios, fondo de comercio, uso, datos u otras pérdidas intangibles, derivados del uso o incapacidad para usar el Servicio, o relacionados con dicho uso o incapacidad de usarlo; y
  • cualesquiera daños y perjuicios, pérdidas o lesiones resultantes de la piratería informática, la manipulación o cualquier otro acceso o utilización no autorizados del Servicio o de la cuenta de Usuario o de la información contenida en estos;
  • cualesquiera errores, equivocaciones o inexactitudes del contenido;
  • daños personales o materiales de cualquier naturaleza resultantes del acceso al Servicio por parte del Usuario o su utilización;
  • cualquier acceso o utilización no autorizados de los servidores seguros del Titular y/o de cualquier información personal almacenada en ellos;
  • cualquier interrupción o cese en la transmisión al Servicio o desde este;
  • cualesquiera errores de programación, virus, troyanos o elementos similares que puedan transmitirse al Servicio o a través de este;
  • cualesquiera errores u omisiones en cualquier contenido o por cualquier pérdida o daños y perjuicios que se produzcan como resultado de la utilización de cualquier contenido publicado, enviado por correo electrónico, transmitido o puesto a disposición de cualquier otra manera a través del Servicio; y/o
  • la conducta difamatoria, ofensiva o ilegal de cualquier Usuario o tercero. En ningún caso serán responsables el Titular o sus filiales, sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios, proveedores o empleados por cualesquiera demandas, procedimientos, responsabilidades, obligaciones, daños y perjuicios, pérdidas o costes por un importe que exceda de la cantidad abonada por el Usuario al Titular con arreglo a las presentes Condiciones en los 12 meses anteriores, o en el plazo de duración del presente Contrato entre el Titular y el Usuario, siendo relevante el plazo más corto de los dos anteriormente mencionados.

Esta sección de limitación de responsabilidad será aplicable en la máxima medida de lo permitido por la ley en la jurisdicción correspondiente, con independencia de si la responsabilidad alegada es de carácter contractual, extracontractual, basada en la negligencia, en la responsabilidad objetiva o en cualquier otro supuesto, incluso si se ha advertido al Usuario de la posibilidad de tales daños y perjuicios.

Algunas jurisdicciones no permiten la exclusión o la limitación de los daños incidentales o emergentes y, por tanto, las limitaciones o exclusiones antes mencionadas podrían no ser aplicables al Usuario. Las presentes Condiciones otorgan al Usuario derechos legales específicos y el Usuario puede disponer también de otros derechos, que variarán dependiendo de la jurisdicción. Las cláusulas de exención de responsabilidad, exclusiones y limitaciones de responsabilidad en virtud de las presentes Condiciones no serán aplicables en la medida en que estén prohibidas por la ley aplicable.

Exención de responsabilidad

El Usuario acuerda defender, eximir y liberar de toda responsabilidad al Titular y a sus filiales, sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios, proveedores y empleados en relación con cualquier demanda o reclamación, daños y perjuicios, obligaciones, pérdidas, responsabilidades, costes o deudas y gastos, incluyendo, de forma enunciativa y no limitativa, gastos y costas legales, derivados de:

  • la utilización del Servicio por parte del Usuario o su acceso a este, incluyendo cualesquiera datos o contenidos transmitidos o recibidos por el Usuario;
  • el incumplimiento por parte del Usuario de las presentes Condiciones, incluyendo, de forma enunciativa y no limitativa, la vulneración por parte del Usuario de cualquiera de las declaraciones y garantías establecidas en las presentes Condiciones,
  • la vulneración por parte del Usuario de cualesquiera derechos de terceros, incluyendo, de forma enunciativa y no limitativa, cualquier derecho a la privacidad o derechos de propiedad intelectual;
  • la infracción por parte del Usuario de cualquier ley, norma o reglamento;
  • cualesquiera contenidos que sean publicados desde la cuenta del Usuario, incluyendo el acceso de terceros con el nombre único del Usuario, la contraseña u otras medidas de seguridad únicas del Usuario, en su caso, incluyendo, de forma enunciativa y no limitativa, la información engañosa, falsa o inexacta;
  • la conducta dolosa del Usuario; o
  • la infracción de cualquier disposición legal por parte del Usuario o de sus sociedades afiliadas, directivos, administradores, agentes, cotitulares de marcas, socios, proveedores y empleados en la máxima medida de lo permitido por la ley aplicable.

Disposiciones comunes

No renuncia

La falta de ejercicio de cualquier derecho o el hecho de no invocar una disposición en virtud de las presentes Condiciones no constituirán una renuncia a dicho derecho o dicha disposición. No se considerará que ninguna renuncia constituya a su vez una renuncia adicional o continuada a dicho término o a cualquier otro término.

Interrupción del servicio

Para garantizar el mejor nivel de servicio posible, el Titular se reserva el derecho a interrumpir el Servicio para labores de mantenimiento, actualizaciones del sistema o cualesquiera otros cambios, informando adecuadamente a los Usuarios.

Dentro de los límites de la ley, el Titular también podrá decidir suspender o dejar de prestar por completo el Servicio. Si el servicio deja de prestarse, el Titular cooperará con los Usuarios para permitirles retirar datos personales o información y respetará los derechos de los Usuarios relativos al uso continuado/la continuación en el uso del producto y/o la compensación, según establezca la ley aplicable.

Asimismo, el Servicio podrá no estar disponible debido a motivos fuera del control razonable del Titular, como la «fuerza mayor» (p.ej. averías en las infraestructuras o apagones, etc.).

Reventa del Servicio

Los Usuarios no reproducirán, duplicarán, copiarán, venderán, revenderán o explotarán ninguna parte de esta Página Web y de su Servicio sin la autorización previa, expresa y por escrito del Titular, concedida ya sea directamente o a través de un programa de reventa legítimo.

Derechos de propiedad intelectual

Sin perjuicio de cualesquiera disposiciones más específicas de las presentes Condiciones, los derechos de propiedad intelectual, tales como los derechos de autor, derechos derivados de marcas registradas, derechos de patentes y derechos de diseños relativos a esta Página Web son propiedad exclusiva del Titular o de sus licenciantes y están protegidos por las leyes en vigor en materia de marcas y los tratados internacionales relacionados.

Todas las marcas registradas – sean denominativas o gráficas – y cualesquiera otras marcas, nombres comerciales, marcas de servicio, signos denominativos, ilustraciones, imágenes o logotipos que aparezcan en relación con esta Página Web son y seguirán siendo propiedad exclusiva del Titular o de sus licenciantes y están protegidos por las leyes en vigor en materia de marcas y los tratados internacionales relacionados.

Cambios de las presentes Condiciones

El Titular se reserva el derecho a cambiar o modificar de cualquier otro modo las presentes Condiciones en cualquier momento. En tales casos, el Titular informará adecuadamente a los Usuarios de esos cambios.

Dichos cambios solo afectarán a la relación con los Usuarios a partir de la fecha comunicada a los Usuarios.

La continuidad en el uso del Servicio indicará la aceptación por parte de los Usuarios de las Condiciones modificadas. Si los Usuarios no desean quedar vinculados por estos cambios, deberán dejar de usar el Servicio y podrán resolver el Contrato.

La versión aplicable previa regulará la relación antes de la aceptación del Usuario. Los Usuarios podrán obtener cualquier versión previa del Titular.

Si lo exige la ley, el Titular notificará por adelantado a los Usuarios la fecha en que se harán efectivas las Condiciones modificadas.

Cesión del contrato

El Titular se reserva el derecho a transferir, ceder, disponer mediante novación o subcontratar cualquiera de los derechos o las obligaciones establecidos con arreglo a las presentes Condiciones, teniendo en cuenta los intereses legítimos de los Usuarios.

Las disposiciones relativas a los cambios de las presentes Condiciones se aplicarán mutatis mutandis.

Los Usuarios no podrán ceder ni transferir sus derechos u obligaciones con arreglo a las presentes Condiciones en modo alguno, salvo con el permiso por escrito del Titular.

Posibilidad de separar una disposición

Usuarios de EE.UU.

Las presentes Condiciones constituyen el Contrato completo entre los Usuarios y el Titular con respecto al objeto del presente documento y sustituyen a cualquier otra comunicación, incluyendo, con carácter enunciativo y no limitativo, todos los contratos anteriores entre las partes referidos al mismo objeto.
Las presentes Condiciones se ejecutarán en la máxima medida de lo permitido por la ley.

Usuarios de la Unión Europea

En el caso de que cualquiera de las disposiciones de las presentes Condiciones fuera nula, inválida o inejecutable, o se declarara como tal, las partes actuarán con la máxima diligencia para acordar de forma amistosa unas disposiciones válidas y ejecutables que sustituyan a las partes nulas, inválidas o inejecutables.
En caso de que no se lograra llegar a dicho acuerdo, las disposiciones nulas, inválidas o inejecutables serán sustituidas por las disposiciones aplicables establecidas por la ley, si la normativa aplicable lo permite o establece de este modo.
Sin perjuicio de lo anterior, la nulidad, invalidez o la imposibilidad de ejecutar una disposición concreta de las presentes Condiciones no anularán el Contrato en su conjunto, salvo que las disposiciones que sean separadas sean esenciales para el Contrato, o tengan una importancia tal que las partes no hubieran celebrado el contrato si hubieran sabido que esas disposiciones no serían válidas, o bien en supuestos en los que las disposiciones restantes darían lugar a dificultades inaceptables para cualquiera de las partes.

Ley aplicable

Las presentes Condiciones se rigen por las leyes del lugar en el que tenga su sede el Titular, según lo declarado en la sección correspondiente del presente documento, sin tener en cuenta los principios sobre conflictos de leyes.

Primacía del Derecho nacional

Sin embargo, sin perjuicio de lo anterior, si el Derecho del país en el que está situado el Usuario establece unos estándares de protección al consumidor aplicables más elevados, prevalecerán dichos estándares más elevados.

Excepción para los Consumidores situados en Suiza

Si puede considerarse que el Usuario es un Consumidor situado en Suiza, será de aplicación la ley suiza.

Exceção para Consumidores no Brasil

Se o Usuário se qualificar como um Consumidor Brasileiro e o produto e/ou serviço for comercializado no Brasil, será aplicada a legislação brasileira.

Fuero jurisdiccional

La competencia exclusiva para resolver cualquier controversia resultante de las presentes Condiciones o relacionada con estas corresponde a los tribunales del lugar en el que se encuentre el domicilio social del Titular, como se indica en la sección correspondiente del presente documento.

Excepción para Consumidores situados en Europa
